New Legislation aims to improve stability, predictability and transparency of the Property Tax system

Following the official unveiling of the Province’s proposed property tax legislation designed to overhaul New Brunswick’s property tax system, the provincial government has reached out to NBREA to organize a special presentation aimed at answering members’ questions about the proposed changes.

NBREA has served as a resource throughout the government’s research and consultation process, participating in discussions, submitting recommendation reports, and providing a quote for the Province’s official announcement related to the reforms.

The virtual session will take place via Zoom at 10:00 a.m. on Thursday, June 11. The presentation is expected to run approximately 30 to 45 minutes and will include simultaneous French translation.

The Association continues to advocate for a property tax system that supports housing affordability, fairness, market stability, and economic growth while ensuring New Brunswick remains an attractive place to live and invest.

Members are encouraged to review the Province’s announcement and consultation materials to better understand how proposed changes may impact property owners and future market activity.

Members participate in room measurement exercises at the 68th AGM & Conference in April

More than 500 members, sponsors, exhibitors, and guests gathered in Saint John in April for NBREA’s 68th AGM & Mandatory Education Conference.

Preliminary records indicate that more than 410 members completed their 2026 salesperson mandatory education requirement live during the event.

For members who were unable to attend, the education program was professionally audio and video recorded and is now being prepared for online delivery. The online education package, including interactive quizzes and learning components, is expected to launch later this fall.

Members will have until January 31, 2027, to complete the education requirement online.

NBREA extends sincere thanks to all members, sponsors, speakers, exhibitors, volunteers, and staff who contributed to another successful conference.

NBREA’s new Board of Directors Team: 2026

During the 68th AGM & Mandatory Education Conference in Saint John on April 21-22, a new Association President and Board of Directors team was installed.

Michelle Roy of eXp Realty moves into the President’s seat, and Ryan Davison, who wraps up his own two-year term as President, now serves as Past President.

Michelle has served on NBREA’s Board of Directors team for several years, preceded by serving as President and as a Director for the Fredericton Real Estate Board. Check out her detailed bio in our announcement here.

2026 marks the first dues increase since 2017. The red line shows what dues would have been if they were annually increased with inflation.

Annual dues invoices were sent out to 1,533 members on Friday, May 29. For the first time since 2017, annual membership dues and compliance fees are increasing, rising by a combined total of $53.

Since 2017, fees had been intentionally held stable while the Association absorbed rising operating and regulatory costs. While this year’s adjustment represents a change, overall fees remain below what they would have been had they increased annually in line with inflation over the past decade.

A second key change for 2026 is the return of the Mandatory Continuing Professional Development (MCPD) fee following a three-year pause between 2023 and 2025.

Beginning in 2026, the MCPD fee ($150) will be invoiced to all members at the same time — and on the same invoice — as annual dues. This applies whether mandatory education is completed at the AGM or later through the online education program, creating a single, predictable annual billing cycle.

Dues invoices are payable by June 30.

Trevor Koot, CEO of the BC Real Estate Association, updates members on the Cowichan Decision at NBREA’s Conference in April

Recent court decisions involving Aboriginal title claims in both British Columbia and New Brunswick continue to generate discussion across Canada’s real estate and legal sectors.

Most recently, the Supreme Court of Canada declined to hear an appeal related to the Wolastoqey Nation title claim in New Brunswick, confirming the New Brunswick Court of Appeal ruling.

The decision continues to reinforce the importance of understanding the evolving legal landscape surrounding Aboriginal title, privately owned land, and the role of the courts in addressing these issues.

At the same time, NBREA’s current legal perspective is that the ongoing New Brunswick litigation does not place private property owners at risk of losing ownership of their homes or land. The Court of Appeal previously limited the potential remedies in the case to financial compensation that could potentially be paid by the Crown (government), rather than the transfer or revocation of privately owned property.

From a legal perspective, NBREA’s understanding is also that private property owners who are not parties to the litigation are considered “strangers to the claim,” meaning their ownership rights are not directly before the courts in these proceedings.

The current legal framework further indicates that any potential land-related implications arising from the litigation would be limited to certain Crown lands, rather than privately owned property.

NBREA continues to monitor developments and review implications within the New Brunswick regulatory and professional practice context.
